New York State has sued Kalshi, alleging the prediction market operates as an illegal and unlicensed gambling operation within the state.
The lawsuit represents a significant clash between state gambling laws and federal financial regulations, potentially impacting how prediction markets operate across the U.S. If the state prevails, it could set a precedent that limits the ability of federal exchanges to offer event-based contracts in restrictive jurisdictions.
New York officials allege that Kalshi enables unlicensed gambling and allows users between 18 and 20 years old to bet [5], despite state law requiring bettors to be at least 21 [5]. The legal action seeks $100,000 for each unauthorized sports bet [2] and demands that Kalshi repay customers and pay triple its alleged gains [3].
Financial details of the case vary by report. Some sources describe Kalshi as a $22 billion exchange [1], while other reports state that New York filed a $36 billion suit against the company [4].
Tarek Mansour, co-founder and CEO of Kalshi, has pushed back against the allegations. Speaking on CNBC Television, Mansour said, "We operate under federal rules" [0].
A spokesperson for Kalshi said the lawsuit is "political theater" [1]. The company argues that federal regulation of prediction markets preempts the state laws cited by the New York Attorney General’s office.
The New York Attorney General’s office, however, maintains that the platform is an "illegal gambling operation" [2]. The suit targets the intersection of financial derivatives and sports betting, which the state argues falls under its own regulatory purview rather than federal oversight.
